Terms of Use

1. Introduction

These Terms of Use ("Terms") form a binding agreement between you ("user," "you") and ENERGO CHARGERS LLC ("EnerGo," "we," "us"), a company registered in the Republic of Armenia (Registration No. 00546198, Tax ID 999.110.1575696), with its registered office at 45a Mashtots Avenue, Yerevan, Armenia.

They govern your use of the EnerGo mobile application, the EnerGo charging network, and the website at ener-go.am (together, the "Service"). By creating an account or using the Service you confirm that you have read, understood, and accepted these Terms.

2. Definitions

  • App — the EnerGo mobile application for iOS and Android.
  • Charging Station — a charging point operated by EnerGo or by a partner network accessible through the App.
  • Session — a single charging transaction initiated and ended through the App.
  • Wallet — the prepaid balance held in your EnerGo account and used to pay for Sessions.
  • Tariff — the price applied to a Session at a specific Charging Station, displayed in the App before the Session starts.

3. Account & user obligations

You must be at least 16 years old and legally capable of entering into this agreement. During registration you must provide accurate, current information (phone number, email address, name).

You are responsible for keeping your sign-in credentials confidential and for all activity carried out through your account. Notify us immediately at [email protected] if you suspect unauthorised access.

4. Use of the App

The App is licensed to you on a personal, non-exclusive, non-transferable basis for the purpose of using the Service. You agree not to:

  • reverse-engineer, decompile, or modify the App;
  • use the Service to disrupt or interfere with Charging Stations or other users;
  • attempt to gain unauthorised access to our systems;
  • resell access to the Service.

5. Charging-session rules

Before starting a Session you are responsible for confirming that your vehicle and connector are compatible with the selected Charging Station. You must remain available to respond to your Session and to end it through the App when charging completes.

Idle fees may apply at participating stations when a vehicle remains connected after charging ends; the applicable fee is shown in the App before the Session starts.

EnerGo is not responsible for damage caused by vehicle incompatibility, defective vehicles, or failure to follow station instructions.

6. Pricing & tariffs

Tariffs vary by Charging Station, time of day, and operator. The current Tariff for each Charging Station is always displayed in the App before you start a Session, including any per-kWh, per-minute, and idle components.

By starting a Session you accept the Tariff shown at that moment. We may change Tariffs at any time; changes take effect immediately for new Sessions but do not affect Sessions already in progress.

7. Payments & Wallet

The Service operates on a prepaid Wallet model. You top up your Wallet through the App using a third-party payment provider; full card data is not stored on EnerGo systems.

Session cost is deducted from your Wallet balance when a Session ends. You must have sufficient Wallet balance to start a Session. Wallet balance does not earn interest and is not transferable to another user.

8. Refund Policy

Wallet top-ups are non-refundable. Funds added to your Wallet represent prepayment for future charging Sessions and remain available for that purpose for as long as your account is active.

If a Session fails for reasons attributable to EnerGo or the Charging Station (e.g., the Session never delivers energy, the station hardware fails mid-Session, or you are billed in error), the amount charged for that Session will be automatically refunded to your Wallet, normally within 24 hours.

If you believe a Session was incorrectly billed and has not been auto-refunded, contact [email protected] within 14 days of the Session with the Session date, station, and approximate time, and we will investigate.

Refunds of Wallet balance to your original payment method outside the cases above are at EnerGo's sole discretion and may require identity verification.

9. Liability

The Service is provided on an "as-is" and "as-available" basis. EnerGo does not guarantee continuous availability of any Charging Station, uninterrupted operation of the App, or that any particular Charging Station will be operational at a given time.

To the maximum extent permitted by law, EnerGo is not liable for:

  • downtime of individual Charging Stations or partner networks;
  • damage to vehicles caused by vehicle defects, incorrect use, or third-party charging hardware;
  • indirect, incidental, or consequential losses, including lost profit or lost opportunity.

10. Personal data

Your personal data is processed in accordance with our Privacy Policy. By using the Service you confirm that you have read and accepted that Policy.

11. Intellectual property

The App, the EnerGo brand, the website, and all related content are owned by ENERGO CHARGERS LLC and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership right to you.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App and update the "Last updated" date above. Continued use of the Service after such notice means you accept the updated Terms. If you do not accept them, you may close your account as described below.

13. Term, termination & account closure

These Terms remain in force for as long as you have an EnerGo account. You may close your account at any time from within the App.

EnerGo may suspend or close an account that breaches these Terms, is used fraudulently, or for which we are required by law to do so. On closure, any unused Wallet balance is forfeited except where mandatory consumer-protection law provides otherwise.

14. Governing law & disputes

These Terms are governed by the laws of the Republic of Armenia. Disputes that cannot be resolved between us within 30 days of written notice will be submitted to the competent courts of Yerevan, Armenia.
